Flooding 2023 and Severe Storm 2024 - Earth Extraction and Asphalt Industries

Thank you for your efforts addressing the recovery from flooding in 2023 and 2024.

On December 31, 2024, the Governor issued Addendum 5 extending a previous executive order, which temporarily waives certain land use permit conditions and Act 250 permitting requirements to assure availability of material for the use of the State or municipalities, or contractors on behalf of the State or municipalities, to rebuild critical infrastructure impacted by the July 2024 severe storm.

If you are an owner of an earth material pit or quarry or asphalt or concrete plant using the waiver under the Addendum:

  1. Review the latest Flood Recovery Guidance, and
  2. Fill out the revised Documentation Form: Severe Storm 2024 and email it to us.

Reminder of Revised Deadlines

  • Upon expiration of the Governor’s Emergency Declaration - EO waiver ends. Projects must meet compliance standards for operations.
  • By no later than by the first November 15th following expiration of the Governor’s Emergency Declaration - Submit documentation of complete reclamation or site restoration to the Board.
